1. Acceptance of Terms
Welcome to Fapico ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our home services platform, website, and mobile application (collectively, the "Service") operated by Fapico Technologies Private Limited, a company incorporated under the laws of India.
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
We reserve the right to update and change these Terms from time to time without notice. Any new features that augment or enhance the current Service shall be subject to the Terms. Continued use of the Service after any such changes shall constitute your consent to such changes.
2. Service Description and Limitations
Fapico is an online platform that connects customers with verified service providers for various home services including but not limited to cleaning, plumbing, electrical work, appliance repair, pest control, painting, and other household maintenance services.
Service Limitations:
- We act as an intermediary between customers and service providers
- We do not directly provide the services but facilitate connections
- Service availability may vary by location and time
- We reserve the right to refuse service in certain areas or circumstances
- Emergency services may have limited availability and additional charges
All service providers on our platform are independent contractors and not employees of Fapico. We conduct background verification, but customers are encouraged to exercise their own judgment when engaging services.
3. User Responsibilities and Account Terms
Account Registration:
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must be at least 18 years old to create an account
- One account per user is permitted
User Conduct:
- Provide accurate service requirements and property access details
- Be present or arrange for authorized access during service appointments
- Treat service providers with respect and professionalism
- Report any issues or concerns promptly through our platform
- Not misuse the platform for illegal or unauthorized purposes
- Not share false reviews or manipulate ratings
Prohibited Activities:
- Harassment or discriminatory behavior toward service providers
- Attempting to circumvent our payment system
- Sharing inappropriate content or images
- Violating any applicable laws or regulations
4. Booking and Payment Terms
Booking Process:
- All bookings are subject to availability and confirmation
- Service rates are displayed transparently before booking confirmation
- Additional charges may apply for materials, emergency services, or extended work
- Minimum service charges may apply regardless of actual time spent
Payment Terms:
- Payment is due as per the terms specified during booking
- We accept various payment methods including credit/debit cards, digital wallets, and net banking
- All payments are processed securely through encrypted payment gateways
- Prices are inclusive of applicable taxes unless stated otherwise
- Service charges and convenience fees may apply
Billing Disputes:
Any billing disputes must be reported within 7 days of service completion. We will investigate and resolve disputes fairly based on evidence provided by both parties.
5. Cancellation and Refund Policy
Customer Cancellations:
- Free cancellation up to 2 hours before scheduled service time
- Cancellations within 2 hours of service time may incur a cancellation fee
- No-show or last-minute cancellations may result in full charge
- Emergency cancellations due to unforeseen circumstances will be considered case-by-case
Service Provider Cancellations:
- Alternative service provider will be arranged when possible
- Full refund if no alternative can be arranged
- Compensation may be provided for inconvenience in certain cases
Refund Process:
- Refunds are processed within 5-7 business days
- Partial refunds may apply for partially completed services
- Refunds for unsatisfactory service are evaluated case-by-case
- Original payment method will be credited unless otherwise requested
6. Liability and Warranty Disclaimers
Service Quality:
While we strive to connect you with qualified service providers, Fapico does not guarantee the quality, timeliness, or outcome of services provided. Service providers are independent contractors responsible for their own work quality and professional conduct.
Limitation of Liability:
- Fapico's liability is limited to the amount paid for the specific service
- We are not liable for indirect, incidental, or consequential damages
- We do not assume responsibility for property damage caused by service providers
- Users are advised to verify service provider credentials and take necessary precautions
Insurance and Protection:
We maintain appropriate insurance coverage and encourage service providers to carry their own insurance. However, users should check their own insurance policies for coverage of service-related incidents.
Warranty Disclaimer:
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
7. Privacy and Data Usage
Data Collection:
We collect and process personal information as described in our Privacy Policy, which forms an integral part of these Terms. This includes contact information, service preferences, payment details, and usage data necessary to provide our services.
Data Sharing:
- Personal information is shared with service providers only as necessary to fulfill bookings
- We may share anonymized data for analytics and service improvement
- Legal compliance may require disclosure of information to authorities
- We do not sell personal information to third parties
Data Security:
We implement appropriate technical and organizational measures to protect personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet is 100% secure.
User Rights:
Users have the right to access, correct, or delete their personal information, subject to applicable laws and legitimate business needs. Please refer to our Privacy Policy for detailed information about data rights and procedures.
8. Dispute Resolution
Internal Resolution:
We encourage users to first attempt resolution of any disputes through our customer service team. Most issues can be resolved promptly through direct communication and our internal dispute resolution process.
Mediation:
If internal resolution is unsuccessful, disputes may be referred to mediation through a mutually agreed upon mediator in accordance with the rules of the Indian Council of Arbitration.
Arbitration:
- Disputes not resolved through mediation shall be settled by binding arbitration
- Arbitration will be conducted in accordance with the Arbitration and Conciliation Act, 2015
- The seat of arbitration shall be Mumbai, India
- The language of arbitration proceedings shall be English
Governing Law:
These Terms shall be governed by and construed in accordance with the laws of India. The courts of Mumbai, India shall have exclusive jurisdiction over any disputes arising under these Terms.
